The Terms of Service explain how you are permitted to use the services provided by and through our platform, our websites (including without limitation, www.sunco.com), our associated internet properties (either linked by Sunco and/or by affiliated companies) and any software that Sunco may provide to you for download, including in your mobile devices (all of these virtual properties and applications, collectively, the “Site,”). These Terms of Service also govern your use of all the text, data, information, software, analytics, graphics, taryetary content and more (all of which we refer to as “Materials”) that we and/or our affiliates may make available to you, as well as any services and products we may provide through the Site. Collectively, the Site, the Materials, and the services provided by Sunco are referred herein to as the “Service”.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
SECTION 6 – PAYMENT TERMS
You may be able to order and/or pay for our products or services on this website. Sunco processes digital payments through a vendor that accepts the following debit and credit cards for payment: Visa, MasterCard, American Express, JCB, Discover, and Diners Club.
Sunco can also accept PayPal.
Sunco cannot accept cash or check payments.
To be able to order and pay for such products or services, you must supply certain information relevant to your transaction, including your credit or debit card number, the expiration date of your credit or debit card, the name on your credit or debit card, your billing address, and your shipping address. You represent and warrant that you have the legal right to use any credit card or debit card or other payment method utilized in connection with any transaction. Verification of information may be required prior to the acknowledgment or completion of any transaction.
You understand and agree that you are charged at the time you place your order for products or services.
If you believe that there is an error or unauthorized transaction or activity associated with your payment account, you should contact us immediately.
Despite Our best efforts, occasional pricing and other errors may occur on the Platform. Access to the Platform does not constitute the right to purchase products or services featured.
Sunco is not responsible for typographical, pricing or other errors.
SECTION 7 - TAXES
You are solely responsible for sales taxes. Sunco may apply sales tax to your order. You may provide a valid tax exemption certificate to Us.
SECTION 8 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 9 – CUSTOM DUTIES & FEES
Orders shipped outside of the United States may be subject to import taxes, custom duties, and fees levied by the designation country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance must be fulfilled by the recipient; Sunco has no control over these charges, nor can Sunco predict what they may be.
Customs policies vary widely; you should contact your local customs office for more information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates.
SECTION 10 - SHIPPING
Domestic Shipping:
Processing time for each order is approximately 1-3 business days.
Sunco reserves the right to select the shipping method based upon the item(s). All shipments are Ground, carriers include USPS Priority, UPS Ground or FedEx Ground. A signature is required upon delivery for most items. A tracking number will be provided via email after purchase. Shipments are trackable via UPS.com, FedEx.com or USPS.com.
International Shipping:
We ship outside the contiguous United States to international clients, Alaska, and Hawaii only for bulk pricing orders. Orders sent outside the domestic U.S. do not qualify for free shipping.
SECTION 11 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

All Materials contained in the Service are the property of Sunco or our third-party licensors. Except as expressly authorized by Sunco, you may not make use of the Materials. Sunco reserves all rights to the Materials not granted expressly in these Terms.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. Sunco specifically (but without limitation) disclaim all warranties of any kind, whether express or implied, relating to the Service and all products, materials, and content available through the Service, including but not limited to: (a) any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement; and (b) any warranties arising out of course of dealing, usage, or trade. Sunco do not warrant that the Service or any part of the Service, or any products (including prices, product images, specifications, availability, and other descriptions thereof), materials, or content offered or made available through the Service, will be uninterrupted, secure, accurate, complete, reliable, or free of errors, viruses, or other harmful components, and do not warrant that any of the foregoing will be corrected.
Notwithstanding the foregoing, certain suppliers or providers of products sold through the Service may separately provide limited warranties with respect to their products sold through the Service. The disclaimers in this section 17 do not apply to such product warranties provided separately by the suppliers or providers. You assume all risk for all damages that may result from your use of or access to the Service, your dealings with other Service users, and any materials or content available through the Service. You understand and agree that you use the Service and use, access, download, or otherwise obtain materials or content through the Service and any associated sites or Services at your own discretion and risk, and you will be solely responsible for any damage to your property (including your computer system used in connection with the Service) or loss of data that results from the use of the Service or the download or use of such materials or content.
Some jurisdictions may prohibit a disclaimer of certain warranties and you may have other rights that vary from jurisdiction to jurisdiction.
In no event will Sunco be liable to you for any indirect, incidental, special, consequential, punitive damages (including, without limitation damages for damages for loss of profits or revenue, cost of replacement goods, goodwill, use, data, or other intangible losses) arising out of or relating to your access to or use of, or your inability to access or use, the Service or any materials, content, products, or services on or available through the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Sunco have been informed of the possibility of such damage.
You agree that the aggregate liability of Sunco to you for any and all claims arising out of relating to the use of or any inability to use the Service (including any materials, products, services, or content available on or through the Service) or otherwise under these terms, whether in contract, tort, or otherwise, is limited to the greater of: (a) the amounts you have paid to Sunco for the Service or product to which your dispute relates in the 12 months prior to the claim; or (b) $50.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. Accordingly, the above limitation may not apply to you.
Each provision of these terms that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is to allocate the risks under these terms between the parties. This allocation is an essential element of the basis of the bargain between the parties. Each of these provisions is severable and independent of all other provisions of these terms. The limitations in this section 17 will apply even if any limited remedy fails of its essential purpose.
SECTION 18 - INDEMNIFICATION
You agree that you will be responsible for your use of the Service, and you agree to defend, indemnify, and hold harmless Sunco and its officers, directors, employees, consultants, affiliates, subsidiaries, suppliers, service providers, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with: (a) your access to, use of, or alleged use of the Service; (b) your violation of these Terms or any representation, warranty, or agreements referenced in the Terms, or any applicable law or regulation; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (d) any disputes or issues between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (and without limiting your indemnification obligations with respect to such matter), and in such case, you agree to cooperate with our defense of such claim.
SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 20 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 21 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 22 - GOVERNING LAW
If there are laws in your jurisdiction that are applicable to these Terms and create mandatory obligations that cannot be contracted out of or supplanted by other laws, those local laws apply to the extent they are mandatory and cannot be contracted out of or supplanted by other laws. All other issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms, or the rights and obligations of Sunco or you in connection with these Terms will be governed by the laws of the State of California without regard to conflict of law principles. To the extent that any lawsuit or court proceeding is permitted under the Terms, you and Sunco agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Los Angeles County, California for the purpose of litigating all such disputes. The Terms shall be considered to have been made and accepted in Los Angeles County, California.
SECTION 23 - DISPUTE RESOLUTIONS AND ARBITRATION
Please read this carefully . If you are a resident of the United States of America, this affects Your rights. Otherwise, this Section applies to the extent applicable in your jurisdiction
23.1 - Generally. In the interest of resolving disputes between you and Sunco in the most expedient and cost effective manner, you and Sunco agree that any and all disputes arising in connection with these Terms will be resolved by binding individual arbitration. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Our agreement to arbitrate disputes includes, but is not limited to all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, and regardless of whether the claims arise during or after the termination of these Terms.
YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND SUNCO ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS WIDE ARBITRATION.
23.2 - Exceptions. Notwithstanding subsection 23.1, we both agree that nothing in the Terms will be deemed to waive, preclude, or otherwise limit either of our right to: (a) bring an individual action in small claims court; (b) pursue enforcement actions through applicable federal, state, or local agencies where such actions are available; (c) seek injunctive relief in a court of law; or (d) to file suit in a court of law to address intellectual property infringement claims.
23.3 - Arbitrator. Any arbitration between you and Sunco will be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Terms, and will be administered by the AAA. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting Sunco.
23.4 - Notice; Process. A party who intends to seek arbitration must first send a written notice of the dispute to the other, by certified mail or Federal Express (signature required), or in the event that we do not have a physical address on file for you, by electronic mail ("Notice"). Sunco's address for Notice is: Legal Department, 27811 Hancock Parkway
Valencia, CA 91355. The Notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). We agree to use good faith efforts to resolve the claim directly, but if we do not reach an agreement to do so within 30 days after the Notice is received, you or Sunco may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or Sunco will not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. In the event our dispute is finally resolved through arbitration in your favor, Sunco will pay you: (x) the amount awarded by the arbitrator, if any, (y) the last written settlement amount offered by Sunco in settlement of the dispute prior to the arbitrator’s award; or (z) $1,000.00, whichever is greater.
23.5 - Fees. In the event that you commence arbitration in accordance with these Terms, Sunco will reimburse you for your payment of the filing fee, unless your claim is for greater than $10,000, in which case the payment of any fees will be decided by the AAA Rules. Any arbitration hearings will take place at a location to be agreed upon in Sacramento County, California, provided that if the claim is for $10,000 or less, you may choose whether the arbitration will be conducted: (a) solely on the basis of documents submitted to the arbitrator; (b) through a non-appearance based telephonic hearing; or (c) by an in-person hearing as established by the AAA Rules in the county (or parish) of your billing address. If the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In such case, you agree to reimburse Sunco for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator will issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator's ruling on the merits.
23.6 - No Class Actions. YOU AND SUNCO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Sunco agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
23.7 - Modifications In the event that Sunco makes any future change to this arbitration provision (other than a change to Sunco' address for Notice), you may reject any such change by sending us written notice within 30 days of the change to Sunco' address for Notice, in which case your account with Sunco will be immediately terminated and this arbitration provision, as in effect immediately prior to the amendments you reject will survive.
23.8 - Enforceability. If Subsection 23.6 is found to be unenforceable or if the entirety of this Section 23 is found to be unenforceable, then the entirety of this Section 23 will be null and void and, in such case, the parties agree that the exclusive jurisdiction and venue described in Section 22 will govern any action arising out of or related to these Terms

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
